Chi auspica una società orizzontale, ove l’individuo è considerato tale, con i suoi pregi e difetti, e non uno strumento in balìa del potere assoluto, sicuramente sosterrebbe una visione orizzontale anche dei principi costituzionali, specie quelli che accentrano l’attenzione sui “diritti e doveri dei cittadini”. La visione orizzontale dell’individuo, per quanto utopistica possa essere, ha in se una verità profonda: non si può vivere senza il rispetto delle regole, la violazione delle quali, si tramuta in reato. Al reato, segue la pena, che può avere un’essenza retributiva, se si pensa che il reato in quanto “male” procurato, necessiti un’espiazione con l’aggiunta di altro male che è la pena stessa; una visione invece preventiva, in cui si considera la pena un elemento di aprioristica dissuasione al compimento di illeciti, verificatisi i quali, è necessario intervenire a livello sanzionatorio per facilitare una rieducazione dell’autore del fatto. Il 3 c. dell’art 27. Cost, a chiare lettere insiste sulla rieducazione del condannato. In questo caso mi verrebbe in mente di dire: fu vera gloria? Il tempo ha dato ragione ai Padri Costituenti che hanno attribuito questa peculiarità intrinseca alla sanzione penale? La risposta è altamente negativa. In primo luogo, siamo un Paese in cui si legifera malissimo, non avendo assolutamente sviluppato negli ultimi sessant’anni, la capacità di passare dal complesso al semplice. Tale stallo, da un lato ci regala un condensato di reati inutili che nonostante abbiano un riflesso ancestrale sono ancora vivi e vegeti, dall’altro, si aggiunge l’inesistenza della certezza della pena. Quindi il primo vero vulnus, lo troviamo nella quasi totale libertà di azione che viene concessa a chi compie atti illeciti, il quale si sente magnificato nelle sue gesta da un rimprovero sanzionatorio non certo in linea con la gravità di quanto compiuto. Se quindi la certezza della pena non c’è, anche la finalità rieducativa, per quei pochi disperati che finiscono in galera, è una chimera, considerando lo stato pietoso delle carceri italiane. Una capienza carceraria di ben 47000 posti è surclassata da un numero di detenuti pari quasi al doppio, 67000. S’intuisce bene che una cella con dodici persone, diventa una bomba ad orologeria, ove l’azzeramento delle lancette, anche a lungo termine (a voler essere buoni), determina l’inevitabile esplosione. Non siamo più di fronte ad una linea rieducativa, ma innanzi ad una condizione che anche nel soggetto più mite, comporta disturbi della personalità i quali vanno nella direzione opposta a quella sancita dalla Costituzione. E’ davvero triste, pensare che questo tipo di problema, possa essere affrontato con provvedimenti di clemenza o riti premiali che in qualche modo tendono ad evitare il carcere. Non si pensa assolutamente al fatto che l’essenza della nostra base democratica è in declino quando un sistema giudiziario nel suo complesso non funziona né a livello processuale, né a livello penitenziario. Lo sforzo subdolo posto in essere negli ultimi anni di colmare tali lacune con provvedimenti preventivi, non incanta più nessuno, anzi danneggia la comunità. Facciamo un esempio per capirci meglio. Il fanatismo calcistico italico, spesso, si apre a forme di violenza esasperate che mettono a repentaglio l’integrità di persone innocenti e delle forze dell’ordine che riportano non pochi danni in fatto di uomini e mezzi. Nel momento in cui qualcuno viene arrestato per aver causato diversi incidenti, in poche ore torna a casa, e si ripresenta la settimana successiva ai nastri di partenza per una nuova sfida. Se il gladiatore schizofrenico sapesse invece che dopo il suo sfogo emozionale a casa non tornerà, ma sarà giudicato in poche ore, avvertendo poi la famiglia che per un po’ sarà assoggettato ad una purificazione interiore dietro le sbarre, non avremmo bisogno della tessera del tifoso o di interi eserciti pronti a presidiare l’arena (il rettangolo di gioco), i quali hanno un costo esorbitante per le casse dello Stato. Nelle altre nazioni, gli animi ribelli sono stati placati, da noi sono sempre più esagitati. Non si vuol capire che un processo lungo ed inutile, mette in ginocchio anche l’economia, soprattutto in fatto di investimenti stranieri. Può mai un imprenditore svedese trascorrere anni ed anni in tribunale, in attesa che la “potenza celeste” persuada il debitore ad adempiere alla propria obbligazione? Come potete notare, oltre alle veline e ai cigni impantanti nello stagno che i nostri fantastici tg mostrano all’opinione pubblica, c’è altro di cui occuparsi. Ci sono aspetti che sviliscono la nostra italianità e dei quali, sembra non fregare niente a nessuno. Per quale motivo, potrebbe pensare qualcuno di voi? Di motivi ce ne sarebbero tanti, ma uno in particolare va sottolineato: il mestiere politico. La politica in Italia è un vero è proprio mestiere, ove chi arriva ad appoggiare candidamente il posteriore sulla morbida poltrona, difficilmente l’abbandona. Le sedi delle Commissioni di Camera e Senato, ho l’impressione che siano magazzini contenenti scatole di pannoloni, visto che vantiamo una classe dirigente “giovane” e al passo con i tempi. Se quindi Usa e Regno Unito hanno optato per presidenti giovani; se quindi in alcuni paesi la politica è una vera missione a tempo determinato con emolumenti da comuni mortali, mentre in Italia è un vero e proprio paradiso, potremmo mai aspettarci provvedimenti in grado di mettere in crisi l’oasi incantata? Dimenticavo. E’ aperto il casting per la prossima edizione del “Grande fratello”, fatevi avanti, potreste vivere un sogno ad occhi aperti.
